RESOLUTION CONCERNING CTP CONTRACT WITH CARTER-BURGESS

WHEREAS, the City of Jonesboro contracted with FEMA and Carter-Burgess to update the city’s FEMA Flood Insurance Rate Maps (flood maps) through a Community Technical Partnership (CTP) grant;

WHEREAS, the Corps of Engineers - Memphis District (Corps) has provided information to FEMA for the city’s previous and current flood maps and has used the same methodology since 1974 when the city’s first flood maps were published;

WHEREAS, the Corps has observed historical rainfall events for approximately 70 years to supplement its methodology and has observed little or no variations from its studied areas;

WHEREAS, Carter-Burgess used a methodology in the CTP project that, although approved by FEMA, is not calibrated nor uses benchmark information as to accuracy, but has proposed changes to the city’s flood maps that are significant and would adversely effect large portions of the city;

WHEREAS, the City Council authorized the review of Carter-Burgess’ information by BA Engineering and, given very limited time, BA Engineering and the city’s engineering staff cannot support the drastic proposed changes to the city’s flood maps; and

WHEREAS, the City Council wishes to avoid unnecessary and extreme damage to our citizens’ properties caused by Carter-Burgess’ proposed flood map changes.

THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro authorizes Mayor Formon to take the following action:

1. Immediately notify FEMA that the City of Jonesboro will terminate the CTP contract upon expiration of the 60-day notice requirement due to Carter-Burgess’ failure to meet agreed upon review timelines and for other reasons;
2. Immediately notify FEMA that if mandated, the city intends to repay the expended grant funds;
3. Immediately terminate the services of Carter-Burgess and demand the return to the City of Jonesboro by Carter-Burgess of all proprietary information produced by Carter-Burgess r...
