A RESOLUTION TO CONVEY A PORTION OF NORTH MAIN PARK TO THE CITY WATER AND LIGHT PLANT OF JONESBORO

WHEREAS, the City of Jonesboro is the owner of the West 50' of Lots 35, 36 and 37 of the Northwest Addition to Jonesboro, Arkansas, containing 0.20 acres more or less, subject to all rights of ways and easements of record;
WHEREAS, the City, Water and Light Plant of Jonesboro would like to purchase the west 50' of Lots 35, 36 and 37 of Northwestern Addition to Jonesboro, Arkansas, for development of the Second Street well containing 0.20 acres more or less, subject to all rights of ways and easements of record.
WHEREAS, the City of Jonesboro currently maintains the park and equipment at the described property which is also known as North Main Park.
WHEREAS, the City of Jonesboro shall be permitted to install, maintain and own playground equipment in the park.
WHEREAS, the City of Jonesboro shall continue to maintain the property as a City Park.
NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS
SECTION 1: That the City of Jonesboro shall convey the west 50' of Lots 35, 36 and 37 of the Northwest Addition to the City of Jonesboro, Arkansas to the City Water and Light Plant of Jonesboro.
SECTION 2: That the conveyance of this property be subject to the property being forever used as part of a 100' radius well setback for a City, Water and Light well on adjacent property, and if the property is not so used as a well setback that said property shall revert to the City of Jonesboro.
SECTION 3: The Mayor, Doug Formon and City Clerk, Donna Jackson are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate the conveyance of this property.
