AN ORDINANCE TO WAIVE COMPETITVE BIDDING AND PURCHASE SERVICES FROM EMTEC (ENGINEERING MANAGEMENT CORPORATION) FOR ASBESTOS ABATEMENT AT THE COMMUNITY CENTER BASKETBALL COURT AND DECLARING AN EMERGENCY DUE TO SCHEDULED SPRING ACTIVITIES AT THE EARL BELL COMMUNITY CENTER

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1:  That the City of Jonesboro shall purchase services (described in the attached proposal) from EMTEC (Engineering Management Corporation) for asbestos abatement at the Community Center Basketball Court for the sum of $29,995.00.  That said sum shall be paid from Capital Improvements budget.
 
SECTION 2.  That the City Council in accordance with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to issue a purchase order for the above described for the price set forth in Section 1 above.
 
SECTION 3:  It is further found that this is a time sensitive issue due to the scheduled Spring activities at the Earl Bell Community Center, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
