AN ORDINANCE TO VACATE AND ABANDON THE UNIMPROVED PORTION OF KENESAW STREET

BE IT ORDAINED  by  the  City  Council  of  the  City  of  Jonesboro, Arkansas,  that
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the streets designated as follows with the exceptions listed in Section 2:
 
The unimproved portion of Kenesaw Street from the eastern right-of-way line of Metzler Lane east 627.2 feet in length, 30 feet in width.
 
SECTION 2: This property shall be subject to a twenty foot (20') sanitary sewer easement, or drainage easement, (10' either side of the sewer main as constructed) and shall be subject to a ten  (10')  utility easement across the western portion of the property.  Such property shall inure to the abutting property owners on the north side only.
 
SECTION 3: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorded of Craighead County, Arkansas and shall be filed in the Deed Records of such office.   
 
SECTION 4: The City Council of the City of Jonesboro, Arkansas finds and declares that the above streets and portions of streets are not necessary for the general benefit and welfare of the public: that the owners of all the property abutting the above streets are in favor of the closure and vacation of the above street and that therefore an emergency is declared to exist in this ordinance and it shall be in full force and effect form and after its passage and approval.
 
PASSED AND ADOPTED this 1st day of July, 1991.
