AN  ORDINANCE  TO  AMEND  CHAPTER 7.36.01 OF  THE  JONESBORO MUNICIPAL CODE KNOWN AS "SELLING OR DISCHARGING FIREWORKS", TO PROHIBIT SALES WITHIN CITY LIMITS OF THE CITY OF JONESBORO AND FOR  OTHER  PURPOSES IS HEREBY AMENDED AS FOLLOWS:

 NOW, THEREFORE, BE IT ENACTED AND ORDAINED, by the Jonesboro City Council, Jonesboro, Arkansas that Chapter 7.36.01, of the Jonesboro Code of Ordinances, known as "Selling or Discharging Fireworks" be amended as follows:

 

 SECTION 1: It shall be unlawful for any person, firm or corporation, to keep for sale or offer for sale, or to sell, shoot, fire or explode any firecrackers, roman candles, sky-rockets, toy pistols, torpedo or fireworks of any description, within the corporate city limits of the City of Jonesboro, Arkansas.  Any person, firm or corporation found guilty of violating this ordinance, shall be guilty of a Class C misdemeanor, and fined an amount not to exceed $500.00.

 

SECTION 2: That all ordinances or parts thereof that may be in conflict herewith are hereby repealed.

 

SECTION 3: That it is found and declared by the City Council that the regulation and control of fireworks sales and discharge are vital to public concern that the amendments set forth herein are necessary for the public health, safety and welfare to clarify areas covered and is filed a classification of offense.  Now therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.
