RESOLUTION BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS TO ALLOW THE MAYOR TO NEGOTIATE FOR PROPERTIES INVOLVED IN THE ROUNDABOUT PROJECT ON AIRPORT AND AGGIE ROADS IN JONESBORO

WHEREAS, the City of Jonesboro has condemned properties located at Airport and Aggie Road to build the roundabout to alleviate heavy traffic issues at that location; and
WHEREAS, there have been condemnation lawsuits and other lawsuits filed regarding this project that the City of Jonesboro desires to settle, if possible; and
WHEREAS, previous resolutions prohibit the Mayor from offering more than 10% of the appraisal cost for said properties, no matter the extenuating circumstances; and
 
WHEREAS, it is the desire of the City Council to allow the Mayor more flexibility to negotiate the settlement of these lawsuits and the purchase of the properties.  
 
WHEREAS, there is money in the budget for this expense, and no more monies would need to be allocated.
 
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
 
1. The City Council hereby authorizes the Mayor to negotiate the settlement of the above lawsuits and the purchase of said properties.  That the Mayor is authorized to spend up to 35% of the appraised value  of each property, not to exceed $4,500.00, to settle the litigation and procure the properties.
 
2. The Mayor, Harold Perrin, and City Clerk, Donna Jackson, are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate these settlements and purchases.
