AN ORDINANCE AMENDING SECTION 5.16.17. OF THE JONESBORO MUNICIPAL CODE TO INCREASE THE FINES FOR THE FAILURE OF A PROPERTY OWNER OR OCCUPANT TO REMOVE UNSAFE, UNSANITARY OR UNSIGHTLY CONDITION OR CONDEMNED STRUCTURE FROM REAL PROPERTY.

WHEREAS, Section 5.16.16 of the Jonesboro Municipal Code makes it unlawful for a property owner or occupant on any lot or real property to allow weeds to grow higher than twelve (12) inches or to become unsightly or unsanitary or to allow garbage, rubbish, rotting or dead limbs or trees and other unsafe, unsightly or unsanitary articles and things to accumulate on such real property; and,
WHEREAS, Section 5.16.17 of the Jonesboro Municipal Code authorizes the Code Enforcement Officer to remove and correct such unsafe, unsanitary or unsightly condition or condemned structure; and,
WHEREAS, Section 5.16.17 of the Jonesboro Municipal Code authorizes the Code Enforcement Officer to issue a summons citing the owner and/or occupant to Municipal (now District) Court for first offense violation of the provision of Section 5.16.16 of the Jonesboro Municipal Code; and,
WHEREAS, Section 5.16.17 of the Jonesboro Municipal Code establishes fines for the violation of Section 5.16.16 of the Jonesboro Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS
That Section 5.16.17 of the Jonesboro Municipal Code be amended and changed to read as follows:
“…the Code Enforcement Officer is hereby authorized to issue a summons in person or by written notice citing the owner and/or occupant for violation of the provisions of Section 5.16.16 of the Jonesboro Municipal Code. The fine for such violation shall be not less than $50.00 nor greater than $500.00 as to be determined by the District Court Judge.”
