AN ORDINANCE TO VACATE A PORTION OF APACHE STREET BEING 60 FEET IN WIDTH AND RUNNING WEST TO EAST 607.4 FEET

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Council for the City of Jonesboro, Arkansas on the 1st day of June, 1984, to vacate and abandon all that portion of the street designated on the plat of the Spurlock 2nd Addition to said City now appearing of record in Plat Book 198, page 11, in the office of the Recorder of Craighead County, Arkansas.
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street or the portion thereof, hereinbefore described has heretofore been dedicated to the public use as a street herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all owners of the property abutting upon the portion of the street to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely effected by the abandonment of such street.
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the street designated as follows:
A portion of Apache Avenue located in Jonesboro, Craighead County, Arkansas, being 60 feet in width and running West to East 607.4 feet, as shown on a copy of a plat, filed April 10th, 1974 and recorded in Plat Deed Record 198, page 11, being a part of Spurlock First Re-plat to Jonesboro, Arkansas
Section 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of the County.
