AN ORDINANCE TO VACATE AND ABANDON THE NORTH FIVE (5) FEET OF THE FORTY (40) FOOT DRAINAGE EASEMENT ORIGINALLY PLATTED ON THE SOUTH SIDE OF LOT 11 IN SHELBY ACRES, JONEBORO, ARKANSAS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that:

Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally in and to the North five (5) of the forty (40) foot drainage easement originally platted on the South side of Lot 11 of Shelby Acres, Jonesboro, Arkansas, as shown on the attached plat which is incorporated herein.

Section 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas, and shall be filed in the deed records of such office.

Section 3: The City Council of the City of Jonesboro, Arkansas, finds and declares that the above portion of the drainage easement is not necessary for the general benefit and welfare of the public.

Section 4: The City Council further finds and declares that an emergency exists

And this ordinance is necessary for the preservation of public peace, health and safety, and shall take effect and be in full force and effect from and after its passage and approval.

PASSED and ADOPTED this 5^th day of October, 1987.
