AN ORDINANCE CLARIFYING PLANNING COMMISSION DUTIES AND FUNCTIONS; AND DECLARING AN EMERGENCY

WHEREAS, Jonesboro, through adoption of Ordinances No. 1141 and No. 1212, established, in cooperation with Craighead County, the Metropolitan Area Planning Commission (MAPC); and
WHEREAS, the general powers, functions and duties of said Commission were set out in an "Agreement for Joint Planning Cooperation," which agreement and amendments thereto were approved by said ordinances; and
WHEREAS, the powers necessary to carry out the municipal plan have heretofore been conferred on the MAPC, however the status of the city commission whose responsibilities they assumed was not addressed in the subsequent recodification of City ordinances; and
WHEREAS, it is the desire of the City Council that the City Code be clarified with regard to planning commission responsibilities;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION 1: That pursuant to Title 14, Chapter 56, Subchapter 5 of the Arkansas Code of 1987 Annotated, the Metropolitan Area Planning Commission has assumed all city planning commission duties and functions; shall continue to be authorized, and shall continue exercising and performing all planning powers, duties and functions as provided by state law, specifically A.C.A. 14-56-401 through 14-56-425 inclusive, for the City of Jonesboro.
SECTION 2: That all past actions of the Metropolitan Area Planning Commission in the performance of city planning commission duties and functions be, and the same are hereby ratified and confirmed.
SECTION 3: That Chapter 13.04 of the Jonesboro Municipal Code is hereby repealed.
SECTION 4: Emergency Clause. It is hereby determined that proper and uninterrupted planning and associated land use regulation is necessary for continued preservation of the public health, safety, and welfare; therefore, an emergency is hereby declared to exist and this ordinance shall be in ful...
