AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:  

 

SECTION 1: Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro, Arkansas, Be Amended as Recommended by the Metropolitan Area Planning Commission by the changes in zoning classifications as follows:

 

From Residential One (R-1) To Commercial Three (C-3) the following described property.

 

A part of the Northeast 1/4, Southwest 1/4, of Section 33, Township 14 North, Range 4 East, Craighead County Arkansas, being more particularly described as follows:  begin at the Northeast Corner of the Southeast 1/4, Northwest 1/4, of Section 33, Township 14 North, Range 4 East, thence S89°16'W on the 40 acre line 72.50' to the Westerly Right Of Way Line of Arkansas State Highway No. 1; thence S00°21'57"W along said Right Of Way Line 1316.53'; thence S00°41'16"W along said Right Of Way Line 570.08' to the point of beginning proper; thence S00°41'16"W along said Right Of Way Line 278.15'; thence S89°16'10"W - 372.83' to the centerline of Higginbottom Creek; thence N63°12'02"W along said creek centerline 601.60'; thence N89°16'10"E - 913.20' to the point of beginning proper, containing 4.11 acres more or less, subject to all Rights Of Way and easements of record...

 

The above described parcel of land is partially within the Jonesboro Flood Hazard Zone.

 

SECTION 2: It is found and declared by the City Council that the proper use of the tract (tracts) of land described above in this Ordinance is being delayed because of improper zoning, and that therefore, an emergency is hereby declared to exist and this Ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
