AN ORDINANCE PROVIDING FOR THE TAXING OF ADDITIONAL COSTS IN MUNICIPAL COURT FOR CONVICTIONS ON CHARGES OF PUBLIC DRUNKENNESS AND DRIVING WHILE UNDER THE INFLUENCE OF INTOXICANTS

body

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

1: In addition to such costs as are now or hereafter may be provided by law for the Municipal Court for the City of Jonesboro, Arkansas, there shall be levied the following costs:

For any conviction on a charge of public drunkenness……………………………$1.00

For any conviction on a charge of driving while under the influence of intoxicants…$5.00

2: The Municipal Court Clerk shall keep all costs so collected in a separate account which account shall be used in defraying the purchase, maintenance and operation, and expenses of equipment designed to test the fact and degree of intoxication of persons arrested on charges of public drunkenness or driving while under the influence of intoxicants. The  surplus of such account, if any, after accomplishment of above purposes may be used in defraying any other legitimate administrative expenses of the Court.

3: It has been found by the City Council that considerable effort on the part of law enforcement agencies of the city is spent in the apprehension and conviction of violations concerning the use of intoxicants and that the operation of a scientific device for aiding in such enforcement would be of great benefit to such officers and that it is necessary to provide some means of financing the purchase and maintenance of such equipment; therefore, this ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage.

PASSED and APPROVED on this 10th day of July, 1961.
