A RESOLUTION URGING DEFEAT OF PENDING HOUSE BILL 1726

WHEREAS, the Arkansas Legislature is currently considering House Bill 1726 --the so-called "Private Property Protection Act;" and

 

WHEREAS, said Bill purports to protect private property, when in fact, adequate, fair and reasonable protection of private property rights is already provided through the Arkansas State Constitution, as well as the 5th Amendment to the U.S. Constitution; and

 

WHEREAS, the Bill provisions would create a myriad of litigation against local governments; and

 

WHEREAS, the Bill constitutes a potentially massive unfunded State mandate on local governments; and

 

WHEREAS, implementation of the Bill would effectively compromise virtually all current and future local regulatory efforts to insure orderly growth and development; and

 

WHEREAS, passage of House Bill 1726 is not in the best interest of local government or our citizenry;

 

NOW, THEREFORE, be it resolved by the city council of the city of Jonesboro, Arkansas:

 

That  the  State  Legislative  Delegation  be,  and is hereby,  advised of the City of Jonesboro's  opposition  to the  so-called "Private Property Protection Act",  House Bill 1726.
