AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE PURCHASE OF "NET MOTION" SOFTWARE FOR THE POLICE DEPARTMENT USING 2009, 2010, AND 2011 JUSTICE ASSISTANCE GRANT FUNDING.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that:
SECTION 1. That the Police Department of the City of Jonesboro needs to purchase the following: "Net Motion" software.
SECTION 2. That said software can be purchased from "Relativity" (an only source) for the sum of $42,532, which includes the software, 3 years of support, and tax.
SECTION 3. That the City Council in accord with the terms of A.C. A. 14-58-303 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to purchase the above described for the price set forth in Section 2 above.
SECTION 4. That funding for said software will be obtained from the 2009, 2010, and 2011 Justice Assistance Grants.
SECTION 5. It is further found that due to the immediate need to acquire this equipment an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect form and after its passage and approval. The current test phase of this software expires on November 30, 2011; therefore, it is vital to purchase said software prior to this date to avoid an interruption in service.
