APPEAL HEARING - 6:15 P.M. - An appeal hearing was conducted regarding the recommendation of the Metropolitan Area Planning Commission to deny a zoning change from Residential (R-1) to Commercial (C-3), located on the north side of the 3400 Block of Colony Drive. Attorney Charles Mooney, Sr. represented Mr. Mitchell Caldwell in this matter. Mr. Mooney stated the highest and best use of the property is not residential due to a used car lot and transmission shop adjoining his client’s property. City Planner, Jeff Hawkins stated in 1995 a piece of land located near the property in question was zoned commercial three because it was non-conforming and the Metropolitan Area Planning Commission, at that time felt it should be zoned commercial to make the property conforming. Mr. Hawkins explained the current Metropolitan Area Planning Commission was concerned that more commercial zoning could adversely affect residential property values as well as the residential character of the area. He explained the MAPC determined that commercial zoning east of the railroad tracks was not advisable from a planning stand point. Mr. Doug Ward, of 3407 Colony Drive provided Council with a petition containing 12 signatures of local home owners in opposition to the rezoning. He also provided a news article from the Jonesboro Sun regarding the rezoning of property owned by Mr. Farmer in 1996. The news article quoted Mr. Ward as saying if the Farmer property is rezoned it would set a precedent for other residential-to-commercial rezonings in the area. In conclusion, Mr. Ward provided Council with three folders which contained information regarding the property and he reminded Council of the financial investment of each of the individual homeowners represented there tonight.
