A RESOLUTION GIVING NOTICE OF ENFORCEMENT ACTION REGARDING SUBDIVISION INFRASTRUCTURE NOT BEING COMPLETED AS REQUIRED BY LAW

WHEREAS, Title 15 of the Jonesboro Municipal Code regulates the subdivision of property in the City of Jonesboro; and

 

WHEREAS, said regulations require street, drainage, utility, and other infrastructure to be built in subdivisions, with construction thereof meeting certain established standards; and

 

WHEREAS, over the last several years, numerous subdivisions of property have been approved subject to infrastructure being built and completed to City standards; and

 

WHEREAS, an inordinate number of said subdivisions have not been completed as promised, as planned, and as required by law; and

 

WHEREAS, it is the desire of the Mayor and City Council that all required improvements associated with the subdivision of property that has occurred in the past be promptly completed in accordance with Title 15 of the Code; and that Title 15 approval procedures be strictly adhered to with regard to future subdivisions.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

 

SECTION 1. That notice be, and is hereby given to all subdividers of property in the City of Jonesboro that all required infrastructure improvements, including streets and drainage built to City standards, shall be completed, under penalty of law, by September 1, 2001. This Section shall apply to all subdivisions occurring prior to January, 2001.

 

SECTION 2. Construction and completion of all required improvements in subdivisions occurring after January, 2001 shall be diligently pursued in accordance with MAPC approval and Title 15 statutory requirements.

 

SECTION 3. That regulations regarding the subdivision of property, and the proper construction and installation of streets, drainage, and other infrastructure associated therewith, shall be strictly adhered to from this day forward.
