AN ORDINANCE TO AMEND ORDINANCE NUMBER 06:104 AND THE JONESBORO CODE OF ORDINANCES AND REMOVING CITY COUNCIL MEMBERSHIP ON THE BOARD FOR CITY WATER AND LIGHT, AND FOR OTHER PURPOSES

WHEREAS, The City of Jonesboro previously adopted Ordinance Number 06-104 requiring city council membership on certain boards and commissions; and
WHEREAS, a recent Arkansas Attorney General opinion advised that such a requirement on some boards and commissions would be improper; and
WHEREAS, the City of Jonesboro desires to make members on City Water and Light Board consistent with said opinion.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: That Section 2-363 of the Jonesboro Code of Ordinances (formerly 2.60 ) is hereby amended to delete the requirement that two (2) members be City Council members and at least one (1) of the council members be a member of the finance committee.
SECTION 2: That the requirement be only that the two (2) members are residents of the City of Jonesboro.
SECTION 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of conflict.
SECTION 4: The provisions of the ordinance are hereby declared to be severable and if any sections, phrase or provision shall be declared or invalid, such invalidity shall not affect the remainder of the sections, phrases or provisions.
SECTION 5: That the provisions of this ordinance are necessary for the order and conduct of the affairs of the City of Jonesboro and are further needed to insure compliance with Arkansas State Law. Accordingly, an emergency is declared to exist and this ordinance shall be effective immediately upon its passage and approval.
