AN ORDINANCE ABANDONING A PORTION OF RIGHTS OF WAY LOCATED IN THE CITY OF JONESBORO, ARKANSAS AS REQUESTED BY TODD JACKSON

WHEREAS, the City Council of the City of Jonesboro, Arkansas, at its regular meeting hearing the request to abandon a portion of the Rights-Of-Way and easements as shown on the Plat of Woodsprings Estates, Phase III;

For purposes of the legal description, a plat has been attached, and is known as Woodsprings Estates Phase III, Jonesboro, AR, dated May 16, 1991, and last revised July 22, 1993, hereinafter referred to as “The Plat”.

LEGAL DESCRIPTION:

(A) All of Auburndale Drive.
(B) All of Lexington Place.
(C) Easements being requested for abandonment are:
(1) All easements of record, as shown on Lots 22 through 30, inclusive, Block “C”
(2) All easements of record, as shown on Lots 1 through 4, inclusive, Block “H”
(3) All easements of record, as shown on Lots 1 and 2, Block “J”

All being within a portion of Woodsprings Estates, Phase III; LESS AND EXCEPT those sanitary sewer easements containing existing sanitary sewer lines;

WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and

WHEREAS, the abandonment of the aforementioned Rights-Of-Way would not affect the use of and would be in the best interest of all parties concerned.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

SECTION 1: The City of Jonesboro, Arkansas hereby vacates and abandons all of its rights together with the right of the public generally, in Jonesboro, Arkansas.

SECTION 2: A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed Records of Craighead County, Arkansas.
