A RESOLUTION TO CONTRACT WITH JONESBORO CITY STARS BASEBALL AND SOFTBALL PROGRAM TO PROVIDE FREE CITY STARS BASEBALL AND SOFTBALL

WHEREAS, Smallmon, Haynes and McGuire, LLC is a limited liability corporation doing business as Mid-America Sports Management, hereafter known as MASM, and is contracted with the City of Jonesboro to offer sporting activities to the youth of northeast Arkansas at Deral Burrow Baseball Park; and
WHEREAS, Smallmon, Haynes and McGuire have re-organized as a 501 (c) 3 non-profit corporation called Jonesboro City Stars Baseball and Softball Program, hereafter known as JCSBSP, to offer free youth baseball and softball for Jonesboro area youth; and
WHEREAS, the CITY is the owner of public park amenities known as the Deral Burrow Baseball Park; and
WHEREAS, the City of Jonesboro Parks and Recreation Department and JCSBSP have agreed to collaborate on offering free youth baseball and softball at Deral Burrow Baseball Park; and
WHEREAS, JCSBSP and the CITY desire to enter into this agreement for the purpose of evidencing the agreement of the parties with regard to use of the Facilities by JCSBSP and the respective obligations of the parties regarding the use and maintenance of the Facilities;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
Section 1: That the City of Jonesboro, Arkansas shall enter into an agreement with JCSBSP to use the Deral Burrow Baseball Park for baseball games and tournaments. The agreement is attached hereto as Exhibit A.
Section 2: All other previous agreements or contracts with MASM are declared null and void.
Section 3: The Mayor, Harold Perrin and City Clerk, Donna Jackson are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate the agreement.
