AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A 1988 BOMAG BASE ROLLER BW 213.

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
SECTION 1: That the City of Jonesboro MATA Department needs to purchase the following: 1988 Bomag Base Roller BW 213D, serial #400800110, Wain-Roy Swivel attachment W/60 inch ditching bucket, including all piping and equipment to install on 595D John Deere Excavator.
SECTION 2: That said equipment may be purchased from Mahnen Machinery, located in Brunswick, Ohio, for the sum of Forty-Two Thousand Dollars ($43,000). Said price includes delivery to Jonesboro, Arkansas.
SECTION 3: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to purchase the above described for the price set forth in Section 2 above. Said amount shall be paid by money from the MATA Department’s Gravel Road Project line item in the MATA Department Budget.
SECTION 4: It is further found that due to the immediate need to acquire this equipment an emergency is declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
