ORDINANCE TO VACATE AND ABANDON A PORTION OF DOGWOOD LANE

BE IT ORDAINED by the Mayor and Council of the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas on the 21st day of November, 1955 asking the City Council to vacate and abandon the East 150.9 feet of Dogwood Land in Woodland Park Addition to the City of Jonesboro, Arkansas as the same appears in Deed Record 114, page 487 of the records in the office of the Circuit Clerk at Jonesboro, Arkansas designated as follows, to-wit:
The East 150.9 ft. of Dogwood Lane, being that part of Dogwood Lane East of a line extended northward form the Northwest corner of Lot 1 of Block “D” of Elmwood subdivision of Woodland Park 2nd Addition to the City of Jonesboro, Arkansas to the existing South line of Lot 9 of Block “B” of Woodland Park Addition to the City of Jonesboro, Arkansas, and
WHEREAS, after due notices as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and ahs ascertained that the portion of the street hereinabove described has heretofore been dedicated to the public use as a street; has not actually been used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting the portion of the street to be vacated have filed with the City Council their written consent to such abandonment; and the public interest and welfare will not be adversely affected by the abandonment of such portion of said street;
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The City of Jonesboro, Arkansas hereby releases, vacates and abandons all its rights, together with the rights of the public generally, except existing easements, if any, for utility lines, in and to the portion of the street designated as follows:
