AN ORDINANCE TO WAIVE BIDS AND PAY FOR DEBRIS CONTAINERS AND HAULING RELATED TO THE TORNADO EMERGENCY, AND DECLARING AN EMERGENCY

WHEREAS, the tornado of March 28, 2020 resulted in a declaration of an emergency by the Craighead County Judge and the Governor; and,

 

WHEREAS, the tornado caused considerable damage to a Police Department facility located at the airport which, due to public safety, had to be demolished immediately; and,

 

WHEREAS on March 29, 2020, Mayor Perrin authorized staff to engage WastePro to provide containers for the debris of the demolished city facility and have the containers transported for disposal; and,

 

WHEREAS, the total cost for such disposal is $33,406.54, of which a portion is expected to be provided by FEMA disaster funding.

NOW, THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

Section 1: The sum of $33,406.54 will be added to the Police Department's 2020 budget, and said sum shall come from the unappropriated funds in the General Fund, with the expectation that a portion will be reimbursed from FEMA disaster funding.

Section 2: That the City Council, in accord with the terms of A.C.A. Section 14-58-303, states that bidding in this matter was not practical and hereby waives the requirement of competitive bidding due to the emergency situation and the need to demolish the building for public safety.

Section 3: The City Council further finds and declares that an emergency exists due to public safety concerns, and this Ordinance being necessary for the payment, this Ordinance shall take effect and be in full force and effect from and after its passage and approval.
