ORDINANCE TO VACATE AND ABANDON AN ALLEY IN KNIGHT’S SECOND ADDITION

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Arkansas on the 7th day of July, 1958 asking the City Council to vacate and abandon an alley between Block 26 of Knight’s Second Addition to the City of Jonesboro and Ragsdale Subdivision of Block 25 of Knight’s Second Addition to the City of Jonesboro, Arkansas as shown on plat of said blocks as same appears in Deed Record 9, page 374-5 in the office of the Circuit Clerk at Jonesboro, Arkansas, designated as follows, to-wit:
An alley 20 feet wide by 300 feet long, running between Oak Avenue and Cherry Avenue on the East side of Block 26 of Knight’s Second Addition to Jonesboro and the West side of Ragsdale Subdivision of Block 25 of Knight’s Second Addition to Jonesboro; and
WHEREAS, after due notices as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to the heard on the question and has ascertained that the alley hereinabove described has heretofore been dedicated to the public use as an alley; has not been actually used by the public generally for a period of five (5) years prior to the filing of the Petition of Abandonment; that all owners of the property abutting the alley to be vacated have filed with the City Council their written consent to such abandonment; and that public interest and welfare will to be adversely affected by the abandonment of such alley;
NOW, THEREFORE, BE IT ORDAIEND by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The City of Jonesboro, Arkansas hereby releases, vacates and abandons all its right together with the rights of the public generally, in and to the alley designated as follows:
