AN ORDINANCE TO VACATE AND ABANDON BLOCK STREET

WHEREAS,  the Metropolitan Area Planning Commission has recommended that the City Council of the City of Jonesboro, Arkansas vacate and abandon the street designated as Block Street, which appears of record in Book 48, Page 83 in the office of the recorder of Craighead County, Arkansas; and,  
 
WHEREAS, after due notice, the City Council has heard all persons desiring to be heard on the issue and has ascertained that the vacation and abandonment of the street herein described will not adversely affect the public interests and welfare.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas, that:
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the right to the public generally, in and to the street designated as Block Street and as shown on the attached plat which is incorporated herein.
 
SECTION 2: The City Council of the City of Jonesboro, Arkansas, finds and declares that the above street is not necessary for the general benefit and welfare of the public, and that the owners of all the property abutting the above street are in favor of the closures and vacation of the above street.
 
SECTION 3: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
 
SECTION 4: The City further finds and declares that an emergency exists and that Ordinance is necessary for the preservation of the public peace, health, safety and welfare and shall take effect and be in full force and effect from and after its passage and approval.
