ORDINANCE TO VACATE AND ABANDON AN ALLEY WITH THE SOUTH LINE OF JOHNSON AVENUE

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 3rd, day of April, 1972, praying the City Council to vacate and abandon the alley described as:
Begin at the intersection of the East line of Lot 37-block 1 of E.C. Stuck Addition to Jonesboro, Arkansas, with the South line of Johnson Avenue; thence South to the Southeast Corner of Lot 14-Block 1 of said Addition; thence East 20.0’ to the Southwest Corner of Lot 61-Block 1 of said Addition; thence West along said south line 20.0’ to the point of beginning; platted and filed for record in Deed Record Book _____at page _____of the records of the Jonesboro District of Craighead County, Arkansas; and
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley heretofore described has heretofore been dedicated to the public use as an alley; that it has never actually been developed or used by the public for many years; that the owner of all the property abutting upon the alley to be vacated has filed with the City Council his written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights together with the rights of the public generally in and to the alley described as follows:
Begin at the intersection of the East line of Lot 37-block 1 of E. C. Stuck Addition to Jonesboro, Arkansas, with the South line of Johnson Avenue; thence South to the Southeast Corner of Lot 14-Block 1 of said Addition; thence East 20.0’ to the point of beginning.
