ORDINANCE TO VACATE AND ABANDON ALL OF LOMBARDY DRIVE, DAHLIA LANE, GLADIOLA DRIVE, ROSE LANE AND PART OF PARADISE DRIVE

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, March 30, 1971 praying the City Council vacates and abandons the streets described as:

All of Lombardy Drive; all of Dahlia Lane; all of Gladiola Drive; all of Rose Lane; all of Paradise Drive, except that part of Paradise Drive running northwesterly from the eastern intersection line of Progress Drive with Paradise Drive (so that the only streets in the Harley Kiech Addition will be Progress Drive and Paradise Drive running from Elm Road to Progress Drive), in the City of Jonesboro (formerly Town of Nettleton), Arkansas; platted and filed for record in the Recorder’s Office at Jonesboro, Arkansas, in Record Book 123, page, 54; and

WHEREAS, AFTER DUE NOTICE AS REQUIRED BY LAW, THE City Council has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the streets, or portions thereof, hereinbefore described, have heretofore been dedicated to the public use as streets herein described; has never been actually developed or used by the public as streets for many years after the filing of the plat; that all of the owners of property abutting upon the portions of the streets to be vacated above, filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such streets.

NOW THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:

Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates, and abandons all its rights, together with the rights of the public generally in and to the streets described as follows:

All of Lombardy Drive; all of Dahlia Lane; all of Gladiola Drive; all of Rose Lane; all of Paradise Drive, except that part of Para...
