RESOLUTION TO ESTABLISH A POLICY FOR PERFORMING BREATHALYZER TESTS FOR AGENCIES OTHER THAN THE JONESBORO POLICE DEPARTMENT

BE IT RESOLVED THAT THE JONESBORO POLICE DEPARTMENT IS PERFORMING BREATHALYZER TESTS FOR AGENCIES OTHER THAN JONESBORO POLICE DEPARTMENT, AS THE SHERIFF’S DEPARTMENT DOES NOT HAVE A SUFFICIENT NUMBER OF CERTIFIED OPERATORS WITH THE INCREASED DISTANCE TO THE SHERIFF’S DEPARTMENT AND THE INCREASED NUMBER OF REQUIRED COURT APPEARANCES, AND

 

BE IT RESOLVED that the following cost will be assessed to the agencies requesting the examinations:

 

(1)  Fifteen dollars (15.00) per examination for agencies, other than Jonesboro and the Arkansas State Police.

 

(2)  In the event a Jonesboro Officer who administers the examination is required to testify in court, that agency shall reimburse the overtime salary of that Officer at the rate of time and one half of the Officer’s hourly salary.

 

BE IT FURTHER RESOLVED that the State Police are exempted form these fees, as the fine from the citations they write within the City limits go to the City of Jonesboro.
