AN ORDINANCE TO CLOSE A TEN FOOT ALLEY RUNNING EAST AND WEST BETWEEN LOTS 1 THROUGH 7 AND LOTS 8 THROUGH 13 IN BLOCK 1 OF GREGG & HOUGHTON'S SUBDIVISION OF KITCHEN'S PLACE.

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:
 
SECTION 1:    The City Council finds  that a ten foot alley running East and West between Lots 1 through 7 and Lots 8 through 13 in Block l of Gregg & Houghton's Subdivision of Kitchen's  Place is not being used and is not needed  for  public  purpose now or in the for seeable  future.
 
SECTION 2:   The City Council finds that all abutting property owners have agreed to the closing of such alley.
 
SECTION 3:   The City Council pursuant to Arkansas Code of 1987 Ann.  §14-54-104 hereby closes and vacates the ten foot alley running East and West between Lots 1 through 7 and  Lots 8 through 13 in Block 1 of Gregg & Houghton's Subdivision of Kitchen's Place, subject to  utility rights in favor of Arkansas Louisiana Gas Company for maintaining gas line, and such property shall insure to the abutting property owners to the centerline of said alley.
 
NOW,  THEREFORE, the City Council for the City of Jonesboro, Arkansas, does close and vacate that ten foot alley running East and West between Lots 1 through 7 and Lots 8 through 13 in Block of Gregg & Houghton's Subdivision of Kitchen's Place, subject to utility rights in favor of Arkansas Louisiana Gas Company for maintaining gas line, and further, the City Council finds that an emergency exists and this ordinance being necessary for the protection and promotion of the public health, welfare and safety, the same shall take effect from  and after its passage and approval.
 
PASSED AND ADOPTED this 5th day of June, 1989.
