AN ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING EAST AND WEST BETWEEN VINE STREET AND WALNUT STREET

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 18th day of May, 1953, asking the City Council to vacate and abandon all that portion of the alley designated on the plat of Block “N” of Nisbett’s Addition to said City, now appearing on record in Plat Book 18, Page 43, in the office of the Recorder of Craighead County, Arkansas, beginning at Vine Street and ending at Walnut Street.
WHEREAS, after due notices as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley or the portion thereof, hereinbefore described, has heretofore been dedicated to the public use as an alley herein described; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the properly abutting upon the portion of the alley to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1. The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley designated as follows:
The alley running east and west between Vine Street and Walnut Street in Block “N” of Nisbett’s Addition to the City of Jonesboro, Arkansas, said alley being bounded on the north by Lots Four (4), Five (5) and Six (6) of said Block “N”, and on the south by Lots One (1), Two (2) and Three (3) of said Block “N” of Nisbett’s Addition.
SECTION 2. A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Record...
