ORDINANCE TO VACATE AND ABANDON AN ALLEY

WHEREAS, a petition was duly filed with the City council of the City of Jonesboro, Arkansas praying that the City Council vacate and abandon the alley described as:
 
An alley running north and south, bounded on the East side by Lot 13, Gregg and Houghton Subdivision of Kitchen place and bounded on the West side by Lot 4 of Cobb and Lee Survey, part of Section 19, Township 14 North Range 4 East.
 
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley heretofore described has hereto for been dedicated to the public use as an alley; that it has never actually been developed or used by the public for many years; that the owners of all the property abutting upon the alley to be vacated have filed their petition with the City Council for such abandonment; that the public interest and welfare will not be adversely affected by the abandonment of such alley.
 
NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:
 
Section 1: The City of Jonesboro, Arkansas hereby releases, vacates and abandons all its right, together with the rights of the public generally, in and to the alley described as follows:
 
An alley running north and south, bounded on the East side by Lot 13, Gregg and Houghton Subdivision of Kitchen place and bounded on the West side by Lot 4 of Cobb and Lee Survey, part of Section 19, Township 14 North Range 4 East.
 
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County and recorded in the deed records of said county.
 
Section 3: This Ordinance shall take effect and be in force from and after its passage.
 
PASSED and ADOPTED this 17th day of December, 1973.
