Title

AN ORDINANCE TO AMEND SECTION 5.16.16 AND 5.16.20 OF THE GARBAGE, TRASH AND WEEDS CODE ALLOWING SPECIAL CONSIDERATION FOR LARGER TRACTS OF LAND.

Body

WHEREAS, the City of Jonesboro realizes the large expense of maintaining large tracts of land and feels that a buffer cut around such tracts would suffice.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:  that Codes 5.16.16 and 5.16.20 be amended to allow buffers to be cut around any large tract of land that is not a Subdivision as follows:

SECTION 1:                     Large Tract of Land shall mean any tract of land more than 5 acres and not a subdivision.

SECTION 2:                     Subdivision means the division of a lot, tract, or parcel of land into two or more lots, plats, sites, or other divisions of land for the purpose, whether immediate or future, of sale or of building development.

SECTION 3:                     Buffer shall mean cutting of grass, weeds, brush, vines, etc completely around the tract of land to at least a width of 150 feet.

SECTION 4:                     If the tract of land is shown to be a danger to the public peace, health and safety, the entire tract will be cut and such grass, weeds, brush, vines, etc. shall be cut below the 12 inches specified.

Passed and approved this 6th day of November, 2007.
