RESOLUTION ADOPTING DRAINAGE IMPROVEMENT COST-BENEFIT ECONOMIC ANALYSIS FOR PROPERTY ACQUISITION OR CONDEMNATION JUSTIFICATION PURPOSES

WHEREAS, the City of Jonesboro, Arkansas, has a need to acquire private property from time to time for the purpose of making improvements to existing drainage problems; and

 

WHEREAS, the City of Jonesboro desires to establish a policy for existing drainage problems whereby private property may be acquired or condemned based on the justifiable overall benefits to an affected area without establishing a predetermined storm frequency level-of-service for the entire city or without establishing a precedence of acquiring or condemning flooded or flood-prone property;

 

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, THAT:

 

SECTION 1.  The Drainage Improvement Cost-Benefit Economic Analysis as described in Exhibit A is adopted as the City of Jonesboro’s accepted policy for determining the need to acquire or condemn private property for the purpose of providing remedial improvement measures for existing drainage problems.

 

SECTION 2.  Before a determination is made regarding making the drainage improvements, and estimate of costs for damages and cost of improvements shall be preformed for the 1, 2, 5, 10, 25 50 and 100 year storm event.  A benefit cost table shall be prepared for all possibilities.  When the cost of the improvements shall not exceed 75% of the damages for the highest year storm, that condition would be selected and the improvements would proceed.
