A RESOLUTION TO THE CITY OF JONESBORO TO PARTICIPATE IN THE CONSTRUCTION OF A QUASI-REGIONAL DETENTION POND IN WYNDCHASE SUBDIVISION

WHEREAS, the City of Jonesboro wishes to participate in the construction of a quasi-regional detention pond in Wyndchase Subdivision to help alleviate localized downstream flooding;
WHEREAS, Nix Development is the owner and developer of Wyndchase Subdivision and is constructing a neighborhood detention pond to mitigate increased storm water runoff due to this development;
WHEREAS, Nix Development has set aside sufficient property within the development so that the neighborhood detention pond could be enlarged to help alleviate the existing downstream flooding conditions;
WHEREAS, Nix Development has offered to deed the detention pond property to the City of Jonesboro and to enlarge the detention pond to help alleviate localized downstream flooding for a cost of $22,300.00;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
Section 1. The City of Jonesboro shall participate in the construction of a quasi-regional detention pond in the Wyndchase Subdivision and pay Nix Development a sum of $22,300.00 out of 2012 Capital Improvements for the construction of the enlarged detention facility.
Section 2. The City of Jonesboro shall accept title to the detention pond property upon completion of construction and final soil stabilization and shall thenceforth be responsible for both short-term and long-term maintenance of the detention pond property.
Section 3. The Mayor and City Clerk are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
