WHEREAS, the City Council at its regular meeting hearing the request of to abandon a portion of street.

LEGAL DESCRIPTION:

Part of the West 1/2 of Section 36, Township 14 North, Range 4 East and part of the East half of Section 35, Township 14 North, Range 4 East described as follows: Beginning at a point on the West boundary of Commerce Drive where said West boundary intersects the North Right-of-Way of the Burlington Northern Railroad and run South along the West boundary of Commerce Drive to a point on the South Right-of-Way of the Burlington Northern Railroad; thence run in a Southeast direction along said railroad Right-of-Way to a point where the East Right-of-Way of Commerce Drive intersects said South Right-of-Way of Burlington Northern Railroad; thence run North along the East Right-of-Way of Commerce Drive to a point where the East Right-of-Way of Commerce Drive intersects the North Right-of-Way of the Burlington Railroad; thence run Northwest along said railroad Right-of-Way to the point of beginning.

WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and

WHEREAS, the abandonment of Commerce Drive would not affect the use of and would be in the best interest of all parties concerned.

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:

SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights, together with the right of the public generally, in Jonesboro, Arkansas.

SECTION 2: A copy of the ordinance duly certified by the city clerk shall be filed in the office of the recorder of the county and recorded in the deed records of Craighead County.
