BE IT ORDAINED by the City Council of Jonesboro, Arkansas:

 

SECTION 1: Ordinance No. 954 known as the zoning ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the changes in zoning classifications as follows:

 

From Residential (R-2) to Commercial (C-3) the following described property:

 

LEGAL DESCRIPTION:

 

A part of the SW 1/4 of the SE 1/4 of Section 17, Township 14 North, Range 4 East being more particularly described as follows:  Begin at the South 1/4 Corner of Section 17, Township 14 North, Range 4 East; thence North 40.0' to the North R\W Line of Mathews Avenue, the point of beginning proper; thence North 520.14' to the South R\W Line of Washington Avenue; thence S60°03'44" E. Along said R\W Line 998.26' to the p.c. of a curve to the left whose chord bears S60°15'42"E - 24.29'; thence Southeasterly along curve 24.29' to  a point on the North R\W Curve of Mathews Avenue whose chord bears N87°40'53"W - 180.64'; thence Northwesterly along said R\W Curve - 180.76' to the p.c. of said R\W Curve; thence S88°36'11"W along said R\W Line - 705.86' to the point of beginning proper, containing 5.19 acres, more or less, and being subject fence, roadway and power line encroachments, all as shown on the plat of survey.

 

SECTION 2: It is found and declared by the City Council that the proper use of the tract(s) of land described above in this ordinance is being delayed because of improper zoning, and that, therefore, an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
