ORDINANCE TO VACATE AND ABANDON A 10-FOOT ALLEY LOCATED ON THE EAST 48.10 FEET OF LOTS 1 AND 2 OF THE WASHINGTON ADDITION TO JONESBORO, ARKANSAS

In Re: Church of God in Christ, International.
WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 19th day of November, 1984’ asking the City Council to vacate and abandon all that portion of the alley designated on the plat of survey dated October 10th, 1984, which was attached to the Petition and made apart of the Petition; and,
WHEREAS, after due notice as required by law, the City Council of Jonesboro, Arkansas, has at the time and place stated in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinabove described, has been dedicated to the public use as an alley; has not been actually used by the public as an alley for at least five (5) years; that all owners of property abutting the alley sought to be vacated and abandoned have filed with the Council their written consent to such abandonment or have signed the Petition to vacate and abandon the alley; and that the public interest and welfare will not be adversely affected by the vacating and abandoning of such alley.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City Council of Jonesboro, Arkansas, hereby releases, vacated and abandons all of its rights, together with the rights of the public generally, in and to a 10-foot portion of an alley located on the East 48.10 feet of Lots 1 and 2 of Washington Addition to Jonesboro, Arkansas, the same being shown on the plat of survey which is attached hereto and made a part of this Ordinance as if set out word for word herein.
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filled in the Office of the Recorder of Craighead County and recorded in the Deed Records of Craighead County.
