ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED EAST 0.16 ACRES OF PEABODY DRIVE RIGHT -OF- WAY

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION 1: The City of Jonesboro Arkansas hereby releases, vacates and abandons all its rights together with the rights of the public generally, in and to the street right-of-way designated as follows:
 
The east 0.16 acres of Peabody Drive right-of-way in a part of the Southwest Quarter of the Northeast Quarter of Section 33, Township 14 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows:
 
Commencing at the Southeast corner of the Southwest Quarter of the Northeast Quarter of said Section33 (same being the Southeast corner of Lot 5 of  a Replat of Lot 3 of Calvary Chapel Addition); thence North 0° 13' 44" West 198.32 feet to the point of beginning proper; thence South 88°43'40" West 126.09 feet; thence along a curve to the left having a Delta of 67°58'01" and a length of 65.24 feet; thence North 88°43'40" East 113.71 feet; thence South 0° 13'44" East 60.00 feet to the point of beginning proper, containing 0.16 acres more or less..
 
SECTION 2: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
 
SECTION 3: The City Council of the City of Jonesboro Arkansas, finds and declares that the above street right of way is not necessary for the general benefit and welfare of the public; that the owner of all the property abutting the above street right-of-way is in favor of the closure and vacation of the above street right-of-way and that therefore, an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
