AN ORDINANCE ABANDONING THE NORTH ELEVEN FEET OF THE NETTLETON BAPTIST CHURCH RE-PLAT, AND CONFIRMING MAPC APPROVAL OF NETTLETON BAPTIST CHURCH ADDITION

WHEREAS, as a condition of Re-Plat approval, the Nettleton Baptist Church was required, in 1990, to dedicate twenty one (21') feet of Right-of-Way for Nettleton Avenue, between Thorn Street and Clark Street; and
WHEREAS, a portion of said dedication contained an encroachment, thus resulting in the unintended consequence of there being a cloud on the title of the Church's property; and
WHEREAS, on November 9, 1999, the Metropolitan Area Planning Commission approved another Re-Plat of the Church's property, the partial effect of which, with City Council confirmation and acceptance, abandons and vacates the southernmost eleven (11') feet of the said twenty-one (21') foot dedication, and removes the encroachment; and
WHEREAS, it is hereby found and determined that the said eleven (11') feet of Right-of-Way is not needed for public purposes at this time, and that the public interest will not be adversely affected by its abandonment;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That the south eleven (11') feet of the Nettleton Avenue Right-of-Way, between Thorn Street and Clark Street, same being the north eleven (11') feet of the Nettleton Baptist Church Re-plat be, and the same is hereby abandoned and vacated for all future purposes.
SECTION 2: That said eleven (11') feet shall accrue to the contiguous parcel of property to the south, the title of which is held by Nettleton Baptist Church.
SECTION 3: That the Metropolitan Area Planning Commission's approval of the Nettleton Baptist Church Addition, a record Re-Plat incorporating said eleven (11') feet into said Church's described property, is hereby confirmed and accepted.
