ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING NORTH AND SOUTH THROUGH DUNCAN’S SUBDIVISION

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 29th day of August, 1973, praying that the City Council vacate and abandon the alley described as:
An alley running North and South through the middle of Duncan’s Sub-division of Lot 13 of Thorn’s Addition to the Town of Nettleton, Craighead County, Arkansas, bounded on the East by Lots 1, 2 and 3, and on the West by Lots 12, 13, 14, 15, 16 and 17, platted and filed for record in Deed Record Book 23 at page 42 of the records of the Jonesboro District of Craighead County, Arkansas; and,
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley heretofore described as heretofore been dedicated to the public use as an alley; that it has never actually been developed or used by the public for many years; that the owners of all the property abutting upon the alley to be vacated have filed their petition with the City Council for such abandonment; that the public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas hereby released, vacates and abandons all its right together with the rights of the public generally in and to the alley described as follows:
An alley running North and South through the middle of Duncan’s Sub-division of Lot 13 of Thorn’s Addition to the Town of Nettleton, Craighead County, Arkansas, bounded on the East by Lots 1, 2 and 3, and on the West by Lots 12, 13, 14, 15, 16 and 17.
