BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro:

Section 1: Article 5, Section 3 of Ordinance No. 954 is amended to read as follows: Appeals from the enforcement and interpretation of this chapter and requests for variances shall be filed with the zoning officer specifying the grounds thereof. The zoning officer shall forthwith transmit to the Board of Zoning Adjustment all papers constituting the record upon which the action appealed from was taken. The applicant requesting the appeal or variance shall give notice to al property owners immediately adjacent or contiguous to said property involved in the requested variance stating the action requested by personal notice or notice by mail. Proof of notice shall be by receipt signed by the adjacent property owner in the form of an affidavit. Said notice shall be given at least seven days prior to the meeting of the Board of Zoning Adjustment at which said appeal shall be heard.

Section 2: The notice set forth in Section 1 above shall be in addition to any notice required to be given by the Board of Zoning Adjustment.

Section 3: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed.

Section 4: Should any portion of this ordinance be unconstitutional or invalid and so declared by a Court of competent jurisdiction, then the remainder of this ordinance shall not be affected by such partial invalidity.

Section 5: It is found and declared by the City Council that this ordinance being necessary for the preservation of the public peace, health and safety, and emergencies hereby declared to exist and this ordinance shall take effect from and after i...
