AN ORDINANCE TO AUTHORIZE THE CITY OF JONESBORO TO USE RESERVE FUND BALANCES TO FINANCE THE COST OR RELATED COST OF THE ICE STORM, TO APPROPRIATE THE NECESSARY FUNDS, TO EXTEND THE CONTRACT TIME FRAME TO COMPLETE DEBRIS DISPOSAL, AND FOR OTHER PURPOSES

WHEREAS, the City Council of the City of Jonesboro, Arkansas received ice storm related damage beginning January 27, 2009; and

 

WHEREAS, FEMA has approved the reimbursement of 75% of costs incurred to the City of Jonesboro and ADEM has approved the reimbursement of 12.5% of the cost incurred to the City of Jonesboro; the City of Jonesboro will incur the remaining 12.5%; and

 

WHEREAS, the City of Jonesboro desires to extend the term of the contract, to complete disposition of debris.

 

NOW, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

 

Section 1:  The City of Jonesboro will use available reserve fund balances to finance the cost or related cost of the ice storm.  All funds received from State and Federal disaster funds will be applied back to the appropriate fund.

 

Section 2:  There is hereby appropriated the sum of $1,194,306.84, estimated to be the balance owed under the existing contract.

 

Section 3:  That the sum of $408,600.00 previously paid from capital improvements shall be reimbursed from unallocated reserves.

 

Section 4:  Further that the contract with D&J Enterprises shall be extended to allow for disposition of debris until August 7, 2009.  The Mayor and City Clerk are authorized to execute all necessary documents.

 

Section 5:  There is found and declared to be an immediate need for the distribution of said disaster funds to the appropriate accounts.  It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public peace, health and safety shall be in force and effect immediately upon and after its passage.

 

PASSED AND ADOPTED this 11th day of May, 2009.
