RESOLUTION TO SET A PUBLIC HEARING TO VACATE AND ABANDON AN UNIMPROVED PORTION OF A UTILITY EASEMENT IN ROSSLAND HILLS PHASE III AS REQUESTED BY PHILLIPS INVESTMENTS, INC.

WHEREAS, the property owners have filed a petition with the City Clerk of Jonesboro, Arkansas requesting that the unimproved portions of the 10' Utility Easement, and the 20' Drainage Easement described as follows:
A 10' Utility Easement on the east side of the former Lot 16, Block "B", Rossland Hills, Phase III, and a 20' Drainage Easement centered on the former Lot line between Lots 17, and 18, Block "B", Rossland Hills, Phase III, located in the City of Jonesboro, Arkansas.
WHEREAS, a petition has been presented to the City Council of the City of Jonesboro, Arkansas; AND
WHEREAS, Arkansas Statute Annotated 19-3814 requires two week public notice before the above described utility and drainage easement can be vacated and abandoned;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas, that the City Clerk is directed to publish a notice once a week for two consecutive weeks advising the public of the request by the property owners to vacate and abandon the said utility and drainage easements and this matter will be heard before the city council on December 3, 2001 at 6:20 p.m. at City Council Chambers, located at 900 W. Monroe, Jonesboro, Arkansas.
