AN ORDINANCE DESIGNATING CERTAIN TYPES OF DRIVING OF MOTOR VEHICLES, DECLARING IT TO BE A MISDEMEANOR AND PENALTIES DESCRIBED THEREFOR: DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: From and after passage and adoption of this ordinance, it shall be unlawful for any driver of a motor vehicle to follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway or private driveway or lot within the City of Jonesboro.

 

Section 2: The driver of any motor truck or motor truck drawing another vehicle when traveling upon a roadway outside of a business or residence district shall not follow within 200 feet of another motor truck or motor truck drawing another vehicle. The provisions of this section shall not be constructed to prevent overtaking and passing nor shall the same apply upon any lane specially designed for use by motor trucks.

 

Section 3: Any person adjudged guilty of a violation of this section shall upon conviction, be fined in the amount of not less than $10.00 or more than $100.00.

 

Section 4: Should any portion of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, then the remainder of this Ordinance shall not be affected by such partial invalidity.

 

Section 5: It is found and declared by the City Council that this ordinance being necessary for the public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall take effect from and after its passage and approval.
