AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A RESCUE TRUCK FROM PIERCE MANUFACTURING; FOR THE APPROPRIATION OF FUNDS; AND DECLARING AN EMERGENCY

WHEREAS, the Fire Truck Fund contains $207,205.08, of which $110,000.00 of this amount has been appropriated in the 2004 Budget to provide for acquisition of fire apparatus; and

 

WHEREAS, the remainder of the Fire Truck Fund, $97,205.08, plus the anticipated insurance recovery fees shall be applied toward the purchase of the rescue fire truck; and

 

WHEREAS, the Public Safety Committee and Finance Committee have recommended the matter be referred to the full council for approval.

 

BE IT THEREFORE ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

 

SECTION 1: That the Fire Department of the City of Jonesboro, Arkansas is in immediate need to purchase One Heavy Duty Rescue 2004 Truck (VIN # 4PICT02A74A004063) for the replacement of a recently wrecked fire truck vehicle.

 

SECTION 2: That said rescue truck, be purchased from Pierce Manufacturing located in Appleton Wisconsin for the sum of $316, 221.00. 

 

SECTION 3: That $97,205.08 shall be appropriated from the Fire Truck Fund, and be included with the already appropriated Fire Truck Funds and insurance recovery fees for the purchase of the Pierce Rescue Truck.

 

SECTION 4: That the City Council in accord with the terms of A.C.A.  Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to purchase the above described for the price set forth in Section 2 above.

 

SECTION 5: It is further found that due to immediate need to acquire this rescue vehicle an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval. 

 

PASSED AND ADOPTED this the 19th day of July, 2004.
