AN ORDINANCE TO REZONE LOT 1 OF STEWART ADDITION FROM R-1 TO I-1 AND REZONING LOT 2 OF STEWART ADDITION FROM R-1 TO R-2

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: The City of Jonesboro, Arkansas, hereby rezones Lot 1 of Stewart Addition to the City of Jonesboro, Arkansas, from R-1 to I-1, with the following restriction:

 

(A) The use of this tract shall be restricted to warehousing and distribution and light manufacturing and wholesaling operations shall be prohibited.

 

(B) Building setback requirements shall be seven and one-half (7 ½ ) feet on all sides, including rear lot line, and twenty-five (25) feet on all sides abutting a dedicated public street.

 

(C) If the use of this property for warehousing or distribution is discontinued for a period of not less than one (1) year, then the zoning of I-1 shall terminate and the property shall automatically revert to R-3 zoning, provided such change of zoning shall be confirmed by action of the City Council of the City of Jonesboro, Arkansas.

 

SECTION 2: The City of Jonesboro, Arkansas, hereby rezones Lot 2 of Stewart Addition to the City of Jonesboro, Arkansas, from R-1 to R-2.

 

SECTION 3: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that expansion plans of the present owner of the above described property have been stalled due to annexation of the territory by action of the voters and the City Council of the City of Jonesboro, Arkansas, to the economic detriment of such owner and, therefore, an emergency exists and this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force and effect from and after its passage and approval.

 

PASSED AND ADOPTED this 21st day of August, 1989.
