A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE ALL MAINTENANCE AGREEMENTS FOR STORMWATER MANAGEMENT FACILITIES

WHEREAS, a maintenance agreement which assures perpetual maintenance of stormwater management improvements and drainage easements to be dedicated to the City shall be agreed upon by the City and the Developer prior to approval of the final plat.
WHEREAS, each maintenance agreement is approved by the City Engineer and City Attorney prior to approval by Committee and City Council.
WHEREAS, the approval process for the execution of Maintenance Agreements is slowing the completion of private land transactions.
WHEREAS, in an effort to speed up the process, the Stormwater Management Board (SWMB) recommends the City Council for the City of Jonesboro, Arkansas eliminate Committee and City Council approval and authorize the Mayor and City Clerk to execute all Maintenance Agreements for Stormwater Management Facilities after approval by the City Engineer and City Attorney.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
Section 1. The Mayor and City Clerk are hereby authorized by the City Council of the City of Jonesboro, Arkansas to execute all Maintenance Agreements after approval by the City Engineer and City Attorney.
