AN ORDINANCE TO VACATE AND ABANDON A CERTAIN PORTION OF AN ALLEY LYING BETWEEN LOT 3 OF PARK ADDITION AND LOT 6, BLOCK 2 OF COLES SECOND ADDITION TO THE CITY OF JONESBORO, ARKANSAS

WHEREAS, a petition was duly filed with the City Clerk of the City of Jonesboro on August 19, 1957, asking the City Council to vacate and abandon all that portion of an alley between Lot 3 of Park Addition and Lot 6, Block 2, of Coles second addition, as herein below more particularly described, and as same appears on the plat in deed record book 26 page 402 and book 48 page 170 in the office of the Circuit Court Clerk and Recorder at Jonesboro, Arkansas, described as follows:
An alley running East and west being 20 feet wide by approximately 164 feet long, and thence running North being 10 feet wide by 58 feet along, said alley lying between lot 3 of Park addition and Lot 6, Block 2, of Coles second Addition to the City of Jonesboro, Arkansas.
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in said notice, heard all persons desiring to be heard on the question and has ascertained that the alley herein above described as heretofore been dedicated to the public use as an alley; and the same has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; and that all of the owners of the property abutting to that portion of the alley to be vacated have filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by said abandonment.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Jonesboro.
SECTION 1: The City of Jonesboro hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley above described; however, reserving in the City an easement over said alley for purpose of underground drain.
