A RESOLUTION TO CONTRACT WITH THE JONESBORO SOFTBALL ASSOCIATION FOR THE CONSTRUCTION OF A MAINTENANCE FACILITY AT THE SOUTHSIDE SOFTBALL COMPLEX

WHEREAS, Jonesboro Softball Association is an Arkansas not for profit 501 (c) 3 organization created to promote adult and youth softball through the operation of its softball program; and

WHEREAS, the Board of the Developmental Disabilities Services is the owner and lessor of certain public park amenities known as the "Southside Softball Complex";

WHEREAS, the CITY is the lessee of that certain public park amenities known as the "Southside Softball Complex";

WHEREAS, Forrest Steele, the Superintendent of the Human Development Center has granted the City of Jonesboro written permission for the construction of a maintenance facility on the Southside Softball Complex;

WHEREAS, the Jonesboro Softball Association and the City of Jonesboro desire to enter a construction agreement to permit the Jonesboro Softball Association to construct a maintenance facility at the Southside Softball Complex at no cost to the City of Jonesboro; and

NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

SECTION 1:       That the city council of the City of Jonesboro ratifies and re-affirms the lease of the Softball Complex from the Board of Developmental Disabilities Services executed on behalf of the City of Jonesboro by former mayor Hubert Brodell on the 25^th of September, 1997.

SECTION 2:       That the City of Jonesboro shall contract with the Jonesboro Softball Association to construct a maintenance facility at the Southside Softball Complex at no cost to the City of Jonesboro.  A copy of said contract is attached as "Exhibit A."

SECTION 3:      The Mayor, Doug Formon and City Clerk, Donna Jackson are hereby authorized by the City Council of the City of Jonesboro to execute all documents necessary to effectuate this agreement.
