A RESOLUTION TO CONTRACT WITH THE JONESBORO BASEBALL BOOSTERS FOR THE CONSTRUCTION OF BATTING CAGES AT JOE MACK CAMPBELL PARK

WHEREAS, Jonesboro Baseball Boosters is an Arkansas not for profit 501 (c) 3 organization created to promote youth baseball through the operation of its youth baseball program; and
WHEREAS, the CITY is the owner of certain public park amenities known as the "Joe Mack Campbell Park" located at 3021 Dan Avenue; and
WHEREAS, the City of Jonesboro has a "Facility Usage Agreement" with the Jonesboro Baseball Boosters permitting Jonesboro Baseball Boosters to provide a baseball at Joe Mack Campbell Park; and
WHEREAS, the Jonesboro Baseball Boosters and the City of Jonesboro desire to enter an agreement to convert the west bank of tennis courts at Joe Mack Campbell Park into batting cages at no cost to the City of Jonesboro; and
WHEREAS, the Jonesboro Baseball Boosters shall have priority use of the batting cages in accordance with the priority use dates established in the Facility usage Agreement.
NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION 1: That the City of Jonesboro shall contract with the Jonesboro Baseball Boosters to convert the west bank of tennis courts at Joe Mack Campbell Park into batting cages.
SECTION 2 : The Mayor, Doug Formon and City Clerk, Donna Jackson are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
