AN ORDINANCE TO REDUCE THE WIDTH OF UTILITY EASEMENTS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the 10' of the utility easements with the exceptions listed in section 2:

The Southern ten feet (10') of the existing 25' utility easement along the North Side of Lots 1, 3, and 4 of Bramblewood Subdivision, (see attached plat).

SECTION 2: A copy of the Ordinance certified by the City Clerk shall be filed in the Office of the Recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.

SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above easements are not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above easement are in favor of the reduction in width of the above easement and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
